1. Introduction and Acceptance of Terms

1.1. Agreement.

These Terms and Conditions ("Terms") govern your use of the Texaria.com website ("Website") and all products and services offered by Vektornet LLC ("Company," "we," "us," or "our").

1.3. Acceptance.

By accessing, browsing, or purchasing products from the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Website or purchase any products.

2. Digital Products and License

2.1. Product Description.

The Company sells high-resolution digital texture files (the "Products"), primarily in *.png format. Products are digital in nature and no physical goods will be shipped.

2.2. License Grant.

Upon completion of a purchase, the Company grants you a non-exclusive, non-transferable, worldwide license to use the downloaded Products subject to the terms defined below and the rest of this Agreement.

2.3. Permitted Uses (Personal and Commercial).

The license permits you to use the Products in the following ways:

• Personal Use: Use in any non-monetized personal projects (e.g., personal artwork, private portfolio pieces, school projects).
• Commercial Use: Use in projects created for clients or for self-promotion, provided the Product is integrated into a larger, original work. Examples include:
  • Use in digital artwork, 3D models, video games, films, or animations.
  • Use in graphic design, website design, or printed materials (e.g., brochures, advertisements).
  • Creating merchandise (e.g., t-shirts, mugs) where the texture is used as an element of the final, flattened design, and not as a standalone, extractable file.

2.4. Prohibited Uses.

The license expressly prohibits the following uses, which constitute a violation of this agreement and intellectual property rights:

• Resale and Redistribution: You may not sell, sublicense, rent, lend, assign, give away, or otherwise transfer the Products, or the right to use the Products, to any third party. This includes selling the texture files themselves, individually or in a bundle.
• Creating Competing Products: You may not use the Products to create other textures, digital design assets (e.g., brushes, patterns, overlays), templates, or resources that directly compete with the Products sold by Texaria.com.
• Distribution as a Standalone File: You may not distribute the Products in any way that allows for easy extraction or use as a standalone asset (e.g., embedding the raw, high-resolution file in a publicly accessible or downloadable file format).
• Usage in Trademarks/Logos: You may not register or claim trademark or copyright protection for any design incorporating the Products.

2.5. Ownership.

The Company retains all intellectual property rights, title, and interest in the Products. The purchase only grants a license for use, not ownership of the intellectual property.

3. Purchase Procedure

3.1. Account Creation.

To make a purchase, customers must log in or create an account. You are responsible for maintaining the confidentiality of your account credentials.

3.2. Order Placement.

Orders are placed by selecting Products, adding them to the virtual basket, and proceeding to checkout. The order confirmation does not signify acceptance until payment is verified.

3.3. Payment.

All payments must be completed at the time of checkout. We accept the payment methods listed on the Website.

4. Delivery of Digital Products

4.1. Delivery Method.

Upon successful processing and confirmation of payment, the purchased Products will be delivered to the customer via two methods:

• A direct download link will be sent to the email address associated with the customer's account.
• The purchased files will be accessible within the customer's account on the Website.

4.2. Delivery Time.

Delivery is typically instantaneous or within a few minutes of successful payment processing. Delays may occur due to payment verification or technical issues, and the Company is not liable for minor delays.

5. Refunds and Cancellations (User-Friendly Policy)

5.1. Nature of Digital Goods and Waiver of Withdrawal Right.

By purchasing a Product and accepting immediate access to the download link, you expressly consent to the immediate performance of the contract and acknowledge that, under EU and Hungarian consumer law, you waive your statutory 14-day right of withdrawal for that purchase.

5.2. Texaria.com Satisfaction Guarantee and Refund Policy.

Notwithstanding the waiver of the statutory withdrawal right, Vektornet LLC offers a 14-day Satisfaction Guarantee from the date of purchase, subject to the conditions below. Our goal is for every customer to be satisfied with their purchase.

• Eligibility Window: You may request a refund within 14 calendar days of the date of purchase.
• Reason for Refund: We will process refunds for the following reasons:
  • Technical Fault: The file is demonstrably corrupted, contains errors, or is not in the advertised format (*.png), and we are unable to provide a working replacement within 48 hours of being notified.
  • Dissatisfaction: You are reasonably dissatisfied with the quality or description of the texture (e.g., the resolution is significantly lower than advertised, or the texture looks drastically different from the preview image).
  • Proven Billing Error: Duplicate charge or overcharge.

5.3. Conditions of Refund Approval.

• Proof of Deletion: To receive a refund, you must confirm in writing (via email to our support address) that you have permanently deleted all copies of the purchased Product from all storage devices and have not retained any backup copies.
• Account Access: Upon processing a refund, the download link for the specific refunded Product will be permanently revoked from your account access on Texaria.com.
• Refund Method: Refunds will be processed using the original payment method used for the purchase.

5.4. Exclusions (When Refunds Will Not Be Granted).

We reserve the right to deny refund requests if:

• The request is made after 14 days from the purchase date.
• The texture was used in a final, published, or client project prior to the refund request.
• We detect evidence of license abuse or mass refund requests indicating an attempt to unlawfully obtain free Products.

5.5. How to Request a Refund.

To initiate a refund request, please contact our support team at info@texaria.com and provide your Order Number and a clear explanation of the reason for the request.

6. Account Termination

The Company reserves the right to suspend or terminate your account and access to the Products at its sole discretion, without notice, for any conduct that we believe violates these Terms, is harmful to other users, or is otherwise detrimental to the Company or the Website.

7. Limitation of Liability and Disclaimer

7.1. Disclaimer.

The Website and Products are provided on an "as is" and "as available" basis. The Company makes no representations or warranties of any kind, express or implied, regarding the operation of the Website or the information, content, or Products included on the Website.

7.2. Limitation.

To the maximum extent permitted by law, Vektornet LLC shall not be liable for any indirect, incidental, punitive, or consequential damages arising from the use or inability to use the Website or the Products.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Hungary and the European Union, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Budapest, Hungary.
